All work is undertaken on the understanding that it is mutually agreed that the following terms of agreement form an integral part of the contract, written or verbal and that no variation or modification of this contract shall be effective unless accepted by the publisher in writing.
Booking Fee
A booking fee is charged when The Client signs the contract. This fee is deducted in full from the total order.
Payments
Payment for the minimum order (specified in the schedule) and any other known fees to be made not later than 2 days prior to the date the publication goes to press. Payment for any additional work is to be made when this is agreed.
Photographs
All photograph sizes are nominal. the publisher will provide a pleasing colour balance but cannot guarantee exact colour matching. Owing to anomalous reflectance caused by a combination of certain dyes and materials, especially man-made fibres, it is sometimes impossible to record the exact colour of materials as seen by the human eye.
Orders
All orders shall be treated as an extension of the original contract. No responsibility for errors will be accepted unless orders are given in writing.
Prices
All goods and services shall be supplied at the prices ruling at the time of supply.
Artwork Files
Artwork files are stored in an active folder for six months. After this period a search fee may be charged.
Expenses
For location work expenses, car parking and taxis will be charged to the client if deemed necessary by the publisher.
For those location commissions lasting more than six hours it is expected that hot meals will be provided for the publisher and assistants where relevant.
Copyright
The publisher asserts his rights under the Copyright and Related Rights Act 2000 in relation to all the work he creates. It is an offence under this Act to copy, or allow to be copied, any artwork, photograph or other item originated by the publisher.
Internet/www
Artwork, photographs and other images created by the publisher may only be stored, transmitted or made available in electronic form if a written License has been issued by the publisher
License
The publisher will be granted artistic license in relation to all the photographs taken, locations selected, and amount of photography required.
Displays
The publisher asserts his rights under the Copyright and Related Rights Act 2000 to display samples of the work created.
Force Majeuer
The due performance of this contract is subject to alteration or cancellation by the publisher due to changes to the circumstances of the event or any cause beyond his control. In the event of cancellation of this contract by the publisher, he will be liable only to refund fees paid, less any expenses incurred.
Cancellation
The Client may cancel this contract any time prior to the date the publication goes to press by giving written notice to the publisher. The Client will pay to the publisher a sum equal to two thirds of the order specified in the schedule. |
